Meetings that include competitors can obviously be legitimate business activity. But they have the potential to be mischaracterized as a forum for anticompetitive conduct. For that reason, common sense requires us to follow some basic rules that will minimize potential antitrust risk.
We are here to discuss how managed care might be developed for the healthcare industry. Our discussions should be confined to the technology. We should never use our discussions as a forum to discuss either how individual companies compete or price in the marketplace, or to discuss or agree on any type of joint action in the managed care marketplace.
